Any estate must be entered into the Florida probate court. The amount of assets in the estate determines whether the estate can be probated through a Summary Administration or a Formal Administration; (the former is available only to estates valued at $25,000 or less.)

The probate court will determine how the estate’s assets will be distributed to the beneficiaries either through the decedent’s will, or through the state’s default intestacy laws, which determine where property goes when someone dies without a will.*
